  • Hi everyone, I am looking for legal advice. I am not Malaysian, I live in a different continent.

    Background: I recently received a letter from Maxis’ attorneys claiming I owe around Rm654 related to defaulting on wifi payments after I left Sarawak. I was a foreign student at the time.

    Since I don’t live there anymore, I do not have any financial presence in M’sia. Additionally I have forfeited a RM300-ish deposit with them already.

    The letter sounds serious, but I’m unsure how enforceable this actually is given that I do not live in Malaysia anymore.

    My questions are:

    • Is this something I should take seriously even though I no longer reside there?
    
    • Would ignoring it have consequences if I ever return, even for tourism?
    
    • Is it better to try negotiating, or just leave it?
    

    Any guidance or similar experiences would be really appreciated. I’m trying to understand whether this is a genuine legal risk or more of a standard debt collection attempt.

    Okay.. it’s quite simple.

    1. Did you or did you not subscribe to a maxis Telco service while in Malaysia?

    2. When you left Malaysia, did you properly terminate your contract with Maxis and made sure the termination was pushed through?

    Whether this has any bearings on you entering Malaysia in the future. Maybe not. But probably blacklisted by Maxis. If you didn’t properly terminate any contract then, you probably should pay what you owe?

    No issues returning to Malaysia, and no criminal action either. They send this as a scare tactic to thousands of people hoping they pay up, it is rarely followed through due to the costs involved. Your amount owed is not worth it.

    However, you will face difficulties getting a phone/internet line (and probably loan) if you do ever plan to return to Malaysia.
